Terms and conditions of sales
Article 1 - Object
These general conditions of sale aim to define the conditions applicable to any purchase made through the OUTLETSOFADIRECT site as well as the contractual relations between OUTLETSOFADIRECT and any non-commercial person hereinafter referred to as "the CUSTOMER".
The CUSTOMER declares to have taken cognizance of the following provisions before ordering products. The validation of the order by the CUSTOMER implies express, irrevocable and unreserved acceptance by the CUSTOMER of the terms of these general conditions of sale which will prevail over any other general or special conditions not expressly approved by OUTLETSOFADIRECT.
OUTLETSOFADIRECT reserves the right to modify its general conditions of sale at any time.
The applicable general conditions of sale are those in force on the date of the order by the CUSTOMER.
The CUSTOMER will only be able to validate his order after having read these general conditions and having accepted them by checking the icon dedicated to this purpose.
ARTICLE 2 - Legal majority
By validating these general conditions when ordering, the CUSTOMER declares to have the legal capacity allowing the conclusion of a contract, that is to say to have the legal majority and not to be under guardianship or guardianship.
ARTICLE 3 - Characteristics of the products offered
The products offered are those listed in the catalogue published in the OUTLETSOFADIRECT store
These products are offered for a limited time and while stocks last.
The products in the catalogue are accompanied by technical descriptions of partners and suppliers of OUTLETSOFADIRECT as well as photographs and / or videos which reproduce them as faithfully as possible, within the limits of the technique and in compliance with the best market standards.
ARTICLE 4 - Prices
The prices appearing in the catalogue are prices including all taxes in euros taking into account the VAT applicable on the day of the order, excluding processing and shipping costs. The processing and shipping costs indicated in article 8 of these general conditions of sale are the responsibility of the CUSTOMER.
Any change in any VAT will be automatically reflected in the price of the products.
OUTLETSOFADIRECT reserves the right to modify its prices at any time, but the products will be invoiced on the basis of the prices in force at the time of registration of each order. The products remain the property of OUTLETSOFADIRECT until full receipt of the price by OUTLETSOFADIRECT, in principle and accessories (taxes and processing and shipping costs included).
These provisions do not prevent the transfer to the CUSTOMER upon delivery of the risks of loss and deterioration of the products sold as well as the damage they could cause.
ARTICLE 5 - Order
The CLIENT's order is carried out in three stages:
1. The first step consists in the validation by the CUSTOMER of the items (references and quantities) chosen for his order.
The CUSTOMER can then enter a promotional code allowing him to benefit from reductions, if necessary, delete one or more products or modify the quantity.
2. The second step consists in the entry by the customer of the elements of identification and information necessary for the good progress of the order, namely in particular the following elements: last name, first name, complete coordinates of the delivery, address of invoicing.
To do this, the customer will have to create an "account" and choose a username and password.
If the customer has already ordered from the OUTLETSOFADIRECT store, these identification and information elements will have been recorded; he will then have to recall his account (by entering his username and password); once logged into their account, the customer can modify their contact details, if necessary.
3. The third step consists in the final validation of the order.
The customer is presented with a summary of his order equivalent to an order form, including all the items chosen, the invoicing and delivery addresses, the total amount of said items and the transport costs.
At this stage, the customer checks the summary of his order and proceeds if he wishes to modify it. Following these modifications, he will be presented with a new summary of his order thus modified.
Any order, modified or not, must be subject to final validation by the customer in view of the summary mentioned. This is done by clicking on the "validate" button, this constituting the first click.
The customer's order will be confirmed by email. This email confirms that the CLIENT's order has been taken into account by OUTLETSOFADIRECT and not that the product (s) ordered are available.
The order is taken into account and the delivery period begins to run from the date of payment of the order if it is placed before twelve o'clock and if it is a working day.

If the CUSTOMER accepts the replacement product, the return costs resulting from the exercise of the right of withdrawal will be borne by the customer.
OUTLETSOFADIRECT reserves the right to cancel or refuse any order from a CUSTOMER with whom there is a dispute relating to the payment of a previous order.
ARTICLE 6 - Withdrawal
The CUSTOMER has a period of 100 clear days to exercise his right of withdrawal from the date of receipt of his order. When the 100-day period expires on a Saturday, Sunday or a public holiday, it is extended until the next working day. During this period, the CUSTOMER may return at his own expense and without any other penalty the product or products that do not suit him. It should be noted that the return costs can vary between 20 and 150 euros depending on the total weight, size and region. The price of the product (s) purchased will be refunded within 30 days of payment of the sums paid by the CUSTOMER, these sums being beyond this term, bearing interest at the legal rate. This right of withdrawal can only be accepted for products in their original condition and complete (packaging, accessories, instructions) in good condition and accompanied by a copy of the purchase invoice. Products returned incomplete, damaged, damaged or soiled by the CUSTOMER will not be taken back. ARTICLE 7 - Terms of payment

Processing and shipping costs and delivery times
Products can only be shipped in mainland FRANCE and Belgium. Shipments to Corsica may be subject to an additional charge.
The products ordered will be delivered to the address indicated by the CUSTOMER during the ordering process.
When the CUSTOMER orders several products at the same time and these have different shipping times, the order shipping time is based on the longest time.
Participation in handling and shipping costs will only be invoiced for one shipment.
Terms of delivery: products purchased on OUTLETSOFADIRECT are delivered by specialized carrier or collected from a relay point (list on request). This delivery is made either on the doorstep or in the room of your choice. The delivery method depends directly on the type of product ordered.
* Doorstep delivery is made by appointment on the ground floor of your building or your house and concerns any order where the weight of each package is less than 30 kg.
In case of absence, a calling card is left by the carrier inviting you to contact him to schedule a new delivery. The costs associated with this new delivery are the responsibility of the seller.
The customer will have to sign a delivery slip specifying on the one hand the state of the package and on the other hand the state of the product.
No complaint can be taken into account if the customer has not expressly specified on the delivery note any damage occurring during delivery.
* Delivery "to the room of your choice" is by appointment. It concerns any order where at least one of the packages exceeds 30 kg as well as the delivery of armchairs and sofas.
When making an appointment, the customer must notify the carrier of any access difficulties that deliverers may encounter and must ensure the accessibility of the products ordered. All additional costs associated with the rental of a lift, storage or taking incorrect measurements and all risks of damage resulting from these constraints, will be borne by the CUSTOMER.
The customer agrees to be present within the time slot agreed with the transport company. In the event of absence, the cost of redelivery will be borne by the customer. The customer also undertakes to check the conformity of the order and to indicate precisely on the delivery note the state of the package and that of the product.
Except in cases of hidden defects, no complaint will be accepted after receipt of the products if the customer has not followed the procedure detailed above.
OUTLETSOFADIRECT reserves the choice of the carrier and guarantees the correct delivery of the products without prejudice to its right of recourse against any service provider having intervened.
However, OUTLETSOFADIRECT maybe exempted from all or part of its liability by providing proof that the non-performance or poor performance of the contract is attributable either to the CLIENT or to the unforeseeable and insurmountable fact of a third party to the contract or to a case of force majeure. The customer must check the condition of the goods at the time of delivery, and whether the items received correspond to the items ordered in the presence of the carrier before signing the delivery slip. We recommend that you do not throw away the original packaging immediately, it could be used for possible returns.
Except in cases of force majeure, OUTLETSOFADIRECT undertakes to deliver the customer within 15 working days for any product marked "in stock".
For reasons beyond our control, possible delays in delivery may occur, without however giving the customer the right to claim damages. In the event of force majeure (strike, accident, storm, etc.) delivery times may exceed 15 days.
For all products affected by a deadline, the customer may terminate the sales contract by registered letter with acknowledgment of receipt in the event of exceeding the agreed delivery date exceeding fifteen days and not due to a case of force majeure.
The contract will, if applicable, be considered broken upon receipt by OUTLETSOFADIRECT of the letter by which the CUSTOMER informs it of its decision, if delivery has not taken place between the sending and receipt of this letter.
The expressions "subject to unpacking" or "subject to damage" are insufficient to prove the existence of damage. Your reservations must be clear, precise and detailed. The absence of complaints, the non-issuance of reservations on the part of the customer means that the delivered product is deemed satisfactory and cannot be the subject of any subsequent dispute. For example, the customer will not be able to issue a reservation to OUTLETSOFADIRECT after the carrier has left and having signed the delivery note, even if the package has not been opened in the presence of the carrier. In the event of non-conformity of the goods delivered with the goods ordered, after unpacking or upon delivery, the purchaser may refuse the delivered products free of charge. The burden of proof of this non-conformity lies with the purchaser.
The CUSTOMER will exercise this right within 100 working days from the date indicated for the delivery of the product.
ARTICLE 8 - Complaints, Guarantee and After Sales Service
The CUSTOMER is required to check the condition of the packaging and the conformity of the product delivered.
Any complaint concerning a lack, a defect or a nonconformity of the delivered goods is only valid if it is notified within 3 working days after the delivery of the goods in the event of apparent defects, by calling the following telephone number 09.70. 46.95.31 and sending:

In the absence of a complaint made within the aforementioned period, the delivered products will be deemed to comply and accepted by the CUSTOMER.
In the event that the goods delivered do not conform to the customer's initial order, the latter must make the item available for return, in its original packaging or equivalent and must agree with the sales department of OUTLESOFADIRECT d ' a prior appointment with the carrier for the return of the product. OUTLETSOFADIRECT undertakes to either reimburse the customer within 30 days, or return the ordered item to him.
The provisions of this article do not prevent the CUSTOMER from benefiting from the right of withdrawal provided for in article 6 above.
Certain products offered for sale may be subject to the conventional manufacturer's warranty. This guarantee comes within the framework of the legal guarantee of conformity and the legal guarantee against hidden defects.
If this is the case, the CUSTOMER must, in order to invoke this guarantee, send the product to BORRELLO TRADING at his own expense, taking care to attach the original of the invoice.
Any claim made without the possibility of identifying the product by means of the numbered label on it will be excluded from the guarantee.
BORRELLO TRADING then undertakes to send the CUSTOMER at its expense a product in good working order, either by exchange (except in case of out of stock), or by sending the product to the manufacturer for repair.
In case of out of stock or inability by the manufacturer to repair the product, the CUSTOMER will be offered either a similar product or the reimbursement of the initial product.
Defects and deterioration caused by natural wear or by an external accident (incorrect assembly, faulty maintenance, abnormal use, fire, water damage) or by a modification of the product not foreseen or specified by OUTLETSOFADIRECT, are excluded from the guarantee. .
Guarantee conditions specific to bedding.
Our mattresses and box springs are guaranteed for 2 years from the date of delivery against any manufacturing defect, according to articles 1641, 1642 and following of the Civil Code. OUTLETSOFADIRECT undertakes to repair or replace any product recognized as defective due to a manufacturing or material defect. Subject to articles 1 and 2 below, the materials as well as the core of the mattress are guaranteed with the exception of ticks, knits and threads.
1: Excluded from the warranty are any deformation or sagging due to abnormal use of the mattress, any deterioration resulting from an accident, the use of force, any deliberate deterioration, any observation of humidity or exposure to abnormal heat and any deliberate modification to the mattress.
2: The contractual guarantee is also excluded for: any mattress which does not rest on a new box spring corresponding to the dimension of the mattress or if the latter presents a deformation; any mattress showing urine, blood or indeterminate stains will be excluded from the guarantee.
All products are guaranteed against any manufacturing defect for 5 years (unless otherwise specified as well as the motors of the relaxation beds which only have a 2-year guarantee), from the date which appears on the purchase invoice, which OUTLETSOFADIRECT will send. by e-mail, after delivery of the order. The warranty covers all repair or replacement costs, and transport remains the responsibility of the customer. Some items also benefit from the satisfaction guarantee, exclusive to OUTLETSOFADIRECT.
The purchase invoice will be the guarantee of the products purchased. In addition, in the purchase confirmation email of the order, the customer will receive a warranty certificate that he must keep for possible claims. Interventions under the guarantee cannot have the effect of extending the duration of the guarantee.
Under this warranty, the only obligation incumbent on OUTLETSOFADIRECT will be, in its judgment, either the free replacement of the product for an identical product or of an equivalent range if the product is no longer manufactured, or the repair of the product or the item recognized as defective by its services. OUTLETSOFADIRECT reserves the right not to take back the goods to be replaced. Any product required to benefit from the guarantee must first be submitted to the OUTLETSOFADIRECT after-sales service, whose agreement is essential for any replacement or repair.
Exclusions: Any claim for which the delivery address does not correspond to that of the order will be excluded from the guarantee, unless the customer bears the costs of transporting the goods to the initial delivery address indicated in its Defects and deterioration caused by natural wear or by an external accident (incorrect assembly, faulty maintenance, abnormal use, fire, water damage, etc.), or by a modification of the product not foreseen or specified by the seller, are excluded from the warranty.
Likewise, the handles and seams of the mattresses are not covered by the warranty. The warranty does not cover cases where an apparent defect at the time of receipt of the goods has not been declared by the consumer under the conditions set out in this document.
A difference not exceeding 3 centimeters for bedding and 5 cm for armchairs may be noted between the dimensions advertised and those noted on the products. The term “thickness of a mattress” is understood to mean the distance which separates the two faces of the latter, measured at the center of the latter.
In the event of the appearance of mold stains on the mattress, the warranty will only cover the first 6 months from the date of receipt of the same. Indeed, if it was due to a manufacturing defect, these tasks would appear after 15 days, or even a month. A damp stain that forms after two months, for example, can be due to several factors, such as staying in a damp or poorly ventilated room, excessive sweating of the sleeper or incorrect use of the mattress.
All mattresses resting on a non-conforming or inadequate box spring will be excluded from the guarantee.
Mattresses made of material such as latex or viscoelastic cannot be placed on varnished or melamine surfaces, as this type of surface favors the appearance of mold stains.
It is recommended to place latex or viscoelastic mattresses on slatted bases or box springs. For any other surface such as tatami mats, etc., the customer must be vigilant regarding the ventilation of the mattress, because this type of box spring does not promote good ventilation, which can cause damp spots.
In addition, do not place the mattress on a box spring as the warranty will automatically be void.
Firmness level of the mattress. Latex and viscoelastic foam mattresses may suffer from fluctuations in their firmness, this will depend on the parts used in the manufacture of the product. If the customer has purchased two mattresses of the same model simultaneously, he may appreciate slight differences in firmness between the two items due to the manufacturing process.
For mattresses that contain viscoelastic material, in their cores or fillings, if you receive the mattress in winter, you may find it very hard initially, the mattress having been shopped and transported at low temperatures. To know the exact degree of firmness, it will be necessary to place the mattress in a room between 22º and 24º degrees. It may take several days for the mattress to acclimate, although initial firmness will decrease considerably during the first few hours. It should be taken into account that in colder rooms, the mattress will be firmer and in warmer rooms, you will perceive it to be more flexible.
It should be noted that the phase of adaptation to the shape of your body can lead to a slight settling of the filling materials (less than or equal to 20 mm or 2 cm), a loss of firmness (less than 18% of the initial hardness ), loss of mattress height (less than 15%). In any case, the guarantee will apply from a loss of height of more than 20 mm (2 cm) measured with a ruler and at the highest point of an unstitched surface of the plate. Mattresses with an alveolar core may have a slight variation in dimensions linked to the flexible nature of the material. This adaptation is normal. These consequences do not in any way modify the qualities of comfort and solidity of the mattress, and therefore cannot be the subject of a complaint. The measurements of these values must be carried out with a ruler diagonally across the product and on a perfect plane (on the ground for example), approximately 8 hours after use and under normal temperature and humidity conditions (18ºC / 20ºC and 80%).
Odors. Mattresses can emit odors when unpacked. This is due to their plastic packaging and will in no way be harmful to health. They will disappear a few weeks after unpacking.
Sofa and armchair guarantees
The sofas have a 2 year warranty, unless a longer period is specified in the warranty document sent by the manufacturer. During this warranty period, the manufacturer undertakes to repair free of charge any defect which may appear on the sofa in normal use, directly at the customer's premises if this repair is possible. Otherwise, the CUSTOMER must, in order to invoke this guarantee, send the product to BORRELLO TRADING at its own expense, taking care to enclose the original of the invoice.
This warranty will remain invalid for damages produced by:
Transport, accidents, misuse and other damage not due to the normal use of the product by the customer after delivery of the goods. This warranty only covers transport damage caused before receipt of the equipment. Transport the product without the original packaging.
Burns, cuts, chafing, wrinkles, marks, scrapes or other damage caused by animals or improper use of the product.
Use or contact with chemicals (acids, solvents, dyes), paint, ammonia, lacquers or other hairdressing products ...), treatment with maintenance products not indicated for product specific upholstery guaranteed. When maintaining coatings, pay special attention to the manufacturer's cleaning and maintenance advice.
Deterioration of color by exposure of the product to the action of sunlight or other sources of heat. A minimum separation of 60 cm is recommended, depending on the power of the said source and, in any case, the product will be exposed to direct sunlight.
Leather is a natural product exposed to changes in color, texture and elasticity. The presence of folds, marks or the lack of homogeneity in the color, is a natural characteristic of the leather (which denotes its origin and makes the difference with the artificial products), therefore, they cannot be considered as defects of manufacture, and are excluded from this warranty. Manufacturing defects that appear during the first 6 months of use will be covered by the warranty, but once this period has passed, any modification will be due to the use of the product and will not be covered by the warranty.
The loss of volume of polyurethane foam, acrylic fibers, feathers and other stuffing products of cushions (seats, backs and armrests) is a direct consequence of the use of the same, and therefore it should not be not be confused with loss of elasticity or premature wear due to the manufacturing processes or the materials used.
Product tone. Colors and tones shown may vary depending on the monitor in which they are viewed. In the sofas, the correct perception of the tone of the covering can be seen in the leather sample placed in the carousel inserted in the product sheet. The color of the main photo may not be exact, due to variations produced by illumination. If you wish to acquire a model in two sizes and the same color (for example a 3-seater sofa and a chocolate-colored armchair), to obtain the same tone in each of them, you will have to make the purchase in the same order. Otherwise, we cannot guarantee that the tone of each of them will be the same.
Conformity with the model. In the purchase of a sofa or other piece of furniture, you will be sent with the mail of Your Order, an image with the exact characteristics of the model you have purchased. If 24 hours later you have not filed a complaint, and you have paid the amount of your order, it will be understood that you agree with the options of the chosen product.
ARTICLE 9 - Liability
The products offered on the OUTLETSOFADIRECT store comply with the French legislation in force and the standards applicable in FRANCE.
The photos are provided for illustrative purposes and the CUSTOMER must therefore refer to the description of each product to know its precise characteristics.
In the event of a purchase on a professional basis, OUTLETSOFADIRECT will not incur any responsibility for any indirect damage and as a result of the present, operating loss, loss of profits, loss of exchange, damages or costs that may arise as a result of the purchase. Some products.
